Third degree burglary may follow the act of a building without consent, with intent to steal, commit a felony, commit a gross misdemeanor within (or actually committing such a crime within). The sentence is up to 5 years in prison and/or up to a $10,000 fine. Finally, the least severe degree is fourth degree burglary, which means entering a building without consent and either with intent to commit a misdemeanor (not stealing, or committing such a crime). The sentence is up to 1 year in prison and/or up to a $3,000 fine.
