Long Island Robbery Lawyer Jason Bassett Explains the Differences Between Theft and Robbery in New York

Long Island robbery lawyer Jason Bassett releases a new article (https://jbassettlaw.com/what-is-robbery-under-new-york-state-law/) explaining the differences between theft and robbery in New York. The lawyer mentions that under the law, terms can mean something very different from how they are used in common everyday language. The terms “theft” and “robbery” are often used interchangeably in conversations however they are very different legal definitions.

“Theft means that property has been taken from a rightful owner, robbery is generally defined as the taking of property by the use of physical force or the threat of force. Robbery is considered a felony under New York law and is broken down into three degrees, each a different level of the crime with its own punishments and consequences,” says the Long Island robbery lawyer.

The lawyer explains that any degree of robbery is serious and carries significant prison time. First-degree robbery can carry the most serious penalties and can impact a person for the rest of their life even if it is their first offense. A first-degree robbery means that the defendant is accused of stealing from someone while using or displaying a deadly weapon or another dangerous instrument.

Attorney Jason Bassett adds that if an individual is facing first-degree robbery charges with no prior felony convictions, they may be sentenced to 5 years in state prison. Depending on the nature of the crime committed and the prior felony convictions, the sentence can increase to 8 or 10 years. The maximum sentence can be up to 25 years in state prison and the court may order the person convicted to pay a fine or restitution.

According to the defense attorney, “Criminal prosecutors take robbery charges very seriously. Unfortunately, arrests can be riddled with mistakes. There are times when an individual is falsely accused, charged, and even convicted of robbery. This can sometimes happen even though they were never found in possession of stolen property or a weapon and do not even match the description of the robber.”

Lastly, the lawyer emphasizes the importance of having a skilled attorney when someone is facing charges of theft or robbery. Having an experienced lawyer may be able to help the person live a normal life after serving their sentence.
