On April 6, 2011, Alnylam Pharmaceuticals, Inc. (the “Company”) served and filed an Answer and Counterclaim in the action entitled Tekmira Pharmaceuticals Corporation and Protiva Biotherapeutics, Inc., v. Alnylam Pharmaceuticals, Inc. pending in the Business Litigation Section of the Suffolk County Superior Court, in Boston, Massachusetts. A copy of the Company’s Answer and Counterclaim is attached to this Current Report on Form 8-K as Exhibit 99.1 and incorporated herein by reference.
