Item 8.01. Other Events.
On November 2, 2006, TierOne Corporation issued a press release announcing that the United States Court of Federal Claims issued an opinion on October 31, 2006 awarding $4.5 million in damages to TierOne Bank in connection with a lawsuit the Bank filed in 1995 claiming the federal government breached its contract with the Bank upon the enactment of the Financial Institutions Reform, Recovery and Enforcement Act of 1989. A copy of the press release is attached to this Current Report on Form 8-K as Exhibit 99.1 and is incorporated by reference in this Current Report on Form 8-K.
